1. General Usage Terms

Visitors may not copy, reproduce, distribute, republish, or modify any content from the Stay and Trips website without prior written authorization. Downloadable materials, if available, are permitted for personal and non-commercial use only, provided all copyright and ownership notices remain intact.

2. Responsibilities of Local Partners and Suppliers

• All uploaded content (text, media, itineraries, pricing, and materials) must be 100% original and owned by the uploader.
• The experiences or tours listed must be operated directly by you or your company — not subcontracted or outsourced to another party without written consent.
• You must hold full rights for any uploaded media (including photos, videos, or promotional materials). Stay and Trips retains the right to use this media across its marketing channels without additional attribution.
• Uploading or reusing any copyrighted content, including Creative Commons or stock materials without proper license, is strictly prohibited.
• Mismatched or misleading media and text may result in immediate removal and permanent suspension from our platform.
• In case of verified copyright complaints, Stay and Trips may provide your details to the complainant for resolution.

3. Reporting Copyright Violations

If you believe your copyrighted material has been used without authorization on our website, please email us with the following details:

• A clear description of the copyrighted work and the exact URL(s) where the infringement appears.
• Proof of ownership (e.g., registration certificates, metadata, or original files).
• Your contact details including full name, organization (if applicable), email address, and phone number.

Upon receiving a valid notice, our team will initiate an investigation and respond within seven (7) business days. If the uploader fails to respond or provide adequate proof, the infringing content will be removed, and their account may be permanently deactivated.

4. For Copyright Claimants

If you believe that any material available on the Stay and Trips platform infringes your copyright, you may submit a formal notice of infringement to our Legal Department. Your notice must clearly identify the allegedly infringing content and provide sufficient proof of ownership to allow us to evaluate your claim accurately.

Investigation and Response Process

Once your complaint is received, our team will notify the respective vendor or partner and begin a review process. The vendor will have up to seven (7) business days to respond, which may be extended to fourteen (14) business days if additional information is required. If the vendor does not respond within the given timeframe, the claim will be presumed valid, and the infringing content will be promptly removed from our website.

Should the vendor provide insufficient or inconclusive proof of ownership, the disputed tour or experience will be removed permanently, and the vendor’s account may be suspended or terminated. After this process, Stay and Trips may connect both parties to continue any further legal proceedings directly.

Required Information for Submitting a Claim

Please include the following details when submitting your notice:

• The exact permanent URL(s) of each page containing the alleged infringing material, along with clear identification of the specific content in question.
• Your full legal name, company name (if applicable), email address, and active phone number for correspondence.
• A statement confirming that you are the rightful copyright owner or are authorized to act on behalf of the owner.
• Documentary proof of ownership such as copyright registration, publication record, original image metadata, or other verifiable evidence.
• A detailed description of where and how the original material was created, including author/photographer name, date, and location (if applicable).

Please note that Stay and Trips cannot remove or act upon claims where the complainant fails to provide sufficient proof of ownership or where the claim is incomplete.

False or Misleading Claims

Stay and Trips treats all copyright complaints seriously. However, any deliberately false or misleading claim, or any misrepresentation of ownership, may result in legal action, including claims for damages and recovery of administrative and legal costs.

Ownership of Submitted Materials

By submitting any claim, correspondence, or material related to the dispute, you acknowledge that Stay and Trips may retain copies of such material for record-keeping and compliance purposes. Submitted materials will not be published or reused except for purposes of claim verification and communication with involved parties.

5. Image and Media Usage Policy

• Do not upload media containing individuals, private property, or trademarks without explicit consent or a valid license.
• Only upload images you have created, purchased, or licensed with clear documentation of rights.
• Images derived from free or paid sources must include proof of appropriate licensing allowing commercial reuse.
• Stay and Trips reserves the right to watermark media to protect against misuse or unauthorized distribution.

6. Ownership and Liability

By submitting any tour, activity, or content to Stay and Trips, you confirm that you own all associated copyrights and assume complete responsibility for the materials you upload. Stay and Trips is not liable for any content posted by suppliers, and the uploader shall be held accountable for any resulting claims or damages.

7. False or Misleading Claims

Stay and Trips treats all copyright reports seriously. However, any false, malicious, or misleading claims will result in legal action and liability for all damages, including legal and administrative expenses.

8. Legal Jurisdiction

Stay and Trips operates under Indian law, and all disputes related to copyright or intellectual property will fall under the jurisdiction of the courts in Kolkata, West Bengal.
