These Terms and Conditions ("Terms") govern your access to and use of the website, mobile applications and related services provided by Stay and Trips Hospitality Services LLP (referred to as "Stay and Trips", "we", "us" or "our"). By using our Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Platform.
1. Definitions
Platform / Website: Stay and Trips' websites, mobile apps and any other sales channels.
User: Any person using or accessing the Platform.
Member: A User who registers an account on the Platform.
Supplier: A third-party business or individual offering travel products or services (hotels, activities, transfers, airlines, visa agents, etc.).
Booking / Reservation: A confirmed purchase of one or more Services via the Platform.
Services: All offerings booked through the Platform, including tours, activities, hotels, flights, transfers, visas and packages.
User Content: Reviews, photos, messages or other content submitted by Users to the Platform.
2. Scope & Relationship
Stay and Trips provides a platform that connects Customers with Suppliers. We typically act as a facilitator or agent and do not own or operate the underlying services unless explicitly stated. Your contract for any booked Service may be directly with the Supplier and/or governed by the Supplier’s terms, together with these Terms.
3. Eligibility & Accounts
You must be 18 years or older to create an account. Users between 13 and 18 may use the Platform with parental consent. Users under 13 are not permitted. You agree to provide accurate information during registration and to keep your credentials secure. You are responsible for all activity under your account.
4. Bookings & Confirmations
Booking procedures, available dates, prices and specific conditions are shown on the booking flow and confirmation documents (vouchers, e-tickets, or quotations). Once a Booking is confirmed and payment is received as per the applicable schedule, it becomes a binding contract subject to these Terms and the Supplier's terms.
4.1 Supplier Policies
Suppliers may impose requirements (age, medical fitness, ID) or specific rules. If a Supplier refuses service due to non-compliance with their rules, refunds (if any) will be governed by the Supplier’s policy and these Terms.
4.2 Changes by Suppliers
Schedules, inclusions and availability may change. If a Supplier cancels or materially alters a service, we will notify you and offer available remedies: alternative arrangements, credit, or refund depending on the Supplier’s policy and availability.
5. Fees, Payments & Taxes
Fees for Services are displayed during the booking process and may include applicable taxes. You agree to pay all amounts shown including applicable taxes, service fees and any third-party charges. All payments must be made through approved payment gateways or methods displayed on the Platform. We do not store full payment card details; payments are processed by third-party gateways (e.g., Razorpay, Tazapay) and are subject to their terms.
6. Cancellation, Modifications & Refunds
Cancellation and modification rules depend on the type of Booking and Supplier-specific policies. The final Booking confirmation / Quotation sets out the cancellation fees, timeframes and refunds applicable.
6.1 User Cancellation
If you cancel, applicable refunds (if any) will be determined by the policy shown at the time of booking. Some bookings may be non-refundable. Any refunds processed will be subject to deductions (non-refundable convenience fees, taxes or charges imposed by Suppliers).
6.2 Supplier Cancellation
If a Supplier cancels, you will be offered an option to rebook, accept a credit or receive a refund in line with Supplier terms and availability.
6.3 Modifications
Changes requested after confirmation (dates, passenger count, itinerary) may be treated as cancellations and rebookings and may incur modification fees and any difference in price.
6.4 Compassionate & Special Cases
In certain emergency cases (medical, death of an immediate family member), we may, at our discretion, work with Suppliers to secure refunds or credits. Documentary proof is required and all decisions remain subject to Supplier policies and verification.
6.5 No-show & Partial Use
No-shows or partial use of services (e.g., leaving a tour early) generally do not qualify for refunds unless otherwise stated.
7. User Content & Intellectual Property
You retain ownership of your User Content but grant Stay and Trips a worldwide, perpetual, irrevocable, royalty-free license to use, display, distribute and repurpose such content for marketing and operational purposes. You confirm you have rights to post the content and that it does not violate any third-party rights.
7.1 Platform IP
All content on the Platform (text, graphics, logos) is protected by IP laws. You may not copy, republish or create derivative works without our express written permission.
8. Use of Information & Privacy
Use of your personal data is governed by our Privacy Policy. By using the Platform you consent to processing of your data for operational, marketing and transactional purposes and to share information with Suppliers and service partners strictly to fulfil your Booking.
We will not sell your personal data for commercial gain. We may disclose data to law enforcement or regulatory bodies where required by law.
9. Warranty Disclaimer
The Platform and Services are provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, or non-infringement.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Stay and Trips and its officers, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill arising from your use of the Platform or Services.
Our total liability for direct damages arising out of or relating to these Terms shall be limited to the total amount paid by you for the relevant Booking.
11. Force Majeure
We are not liable for failure to perform any obligation due to events beyond our reasonable control (natural disasters, government actions, strikes, pandemics, acts of war, etc.). In such cases we will attempt to provide alternatives where feasible.
12. Indemnification
You agree to indemnify and hold Stay and Trips and its affiliates, officers, employees, and agents harmless from claims, damages, losses and expenses arising from your breach of these Terms, misuse of the Platform, or violation of third-party rights.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India. Notwithstanding the foregoing, we may, in certain cases and where agreed in writing, permit arbitration as the dispute resolution mechanism.
14. Promotions, Credits & Loyalty
Promotional offers, credits or loyalty points are governed by separate terms. Abuse of promotions may result in suspension of benefits. Credits are generally non-transferable and non-refundable unless otherwise stated.
15. Third-Party Links & Services
The Platform may link to third-party sites or services. We do not endorse or control third-party content and are not responsible for their practices or policies.
16. General Provisions
Severability: If a provision is held invalid, the remaining Terms remain in effect.
Amendments: We may modify these Terms from time to time; the latest version will be posted on the Platform. Continued use constitutes acceptance of changes.
Entire Agreement: These Terms together with the Privacy Policy and the Booking confirmation constitute the entire agreement between you and Stay and Trips regarding your use of the Platform.
